We have received a number of calls from the Tampa area from both patients and their families who are in distress regarding how they are being treated under the Marchman Act in Hillsborough county. The reports are basically the same in that there was some non compliance on the part of the respondent/patient when ordered to outpatient treatment and the result was what they referred to as “529”. Which is that they are SENT TO JAIL for 5 months and 29 days waiting for an available bed to open at one of the treatment centers in the area. One woman expressed that she has already done that time in jail and that she was facing it again even though her drug tests were coming up negative for all substances. In addition the woman now has two contempt of court charges on her record that was previously clean. Even the original petitioners were trying to resend their petitions and stop the process. Apparently, even though the law provides for counsel appointed to the respondent who cannot afford their own lawyer, the public defenders office has not been helpful.

This is why we advocate for families to use our Intervention Services to help their loved ones instead of getting entangled in the bureaucracy of legal system. Or at least to retain legal counsel who is knowledgeable and who can advocate for the family in the court system.
